Definitions
In these Terms of Use, unless specified otherwise, words bear their ordinary meaning. Key definitions include:
“Cookies” denoting a set of data sent from a web server and stored on a computer’s hard drive.
“Company” referring to MarkoSol Technologies.
Personal Data” holding the same meaning as defined by the Data Protection Act (Cap. 440 of the Laws of Malta).
“Services” encompassing any services provided by MarkoSol Technologies.
“User(s)” signifying individuals using the Company’s Services or accessing its Website
“Website” indicating the Company’s website, with the URL https://markosolltd.com.
Use Of Services
Accessing and utilizing the Company’s Services via its Website is subject to your adherence to the following Terms of Use. By utilizing the Services provided by the Company, you implicitly agree to be bound by these Terms of Use. The use of the Company’s Services is contingent upon your access to the World Wide Web, whether directly or indirectly. Users are responsible for any fees associated with this access, and they are also accountable for ensuring they possess all requisite equipment to connect to the World Wide Web, regardless of the form such equipment may take.
Proper Use Of Services
Users shall use the Services only for lawful purposes and in particular they shall not:
- make use of any obscene, threatening, menacing, offensive, defamatory materials or such materials as are in violation of any law or regulation, in breach of confidence, harmful to minors, in breach of intellectual property right or otherwise unlawful when making use of the Services
- impersonate any person or entity, falsely state or otherwise misrepresent affiliation with a person or entity;
- make use of the Services so as to cause other Users or third parties to receive unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation
- make use of the Services to knowingly or negligently transmit any electronic material that may be detrimental or/and cause any sort of damage or malfunction to the computer system of the Company or of any other User or third party; and
- collect or store Personal Data about other Users or third parties
Any breach of the aforementioned shall entitle the Company to terminate your use of the Services.
Disclaimer Of Warranties
The Company does not provide any assurance regarding the accuracy, content, completeness, legality, reliability, operability, or availability of information or material made accessible to and/or by Users. Furthermore, the Company does not warrant the correct communication, presentation, or display of the information available to and/or by Users.
To the extent permitted by law, the Company disclaims any and all warranties related to the Services. This includes, but is not limited to, warranties of fitness for a particular purpose and non-infringement of proprietary rights, encompassing intellectual property rights. Additionally, the Company does not guarantee the integrity and correctness of the information on its Website or the services advertised on the Website or made available through linked sites.
In particular, concerning any immovable property advertised on the Website, the Company relinquishes any responsibility for its peaceful possession, title, structural integrity, general conditions, surroundings, and any other conditions that might give rise to liability.
The Company also disclaims any responsibility for damages that Users may incur when utilizing the Services. Moreover, the Company denies responsibility for any improper use of Users’ Personal Data.
Limitation Of Liability
In no event shall the Company be held liable for any damages of any kind whatsoever to any User.

The Company holds no responsibility for any content displayed on the Website or linked to the Website. The Company does not make any representations regarding any efforts to review the content and shall not be held liable or responsible for the accuracy, copyright, trademark compliance, or legality of any content.
Intellectual Property
The Company exclusively owns or controls all rights, including copyright, in the content displayed on the Website. Users are permitted to download the content solely for their personal non-commercial use.
Users are expressly prohibited from copying, broadcasting, downloading, storing (in any medium), transmitting, showing, or playing in part or in whole, adapting, or changing the content of the Website for any other purpose without obtaining the prior written permission of the Company.
Changes In Terms Of Use And Service
The Company retains the right to change, alter, or modify the Services periodically, for any reason, with or without notice, including the right to terminate the services provided by the Company. Furthermore, the Company reserves the right to change, alter, or modify the present Terms of Use without prior notice.
Privacy
The Privacy Policy of the Company, as outlined herein, does not apply to data and/or information that a User may disclose to another User.
Governing Law
Any disagreements, issues, or disputes arising from or related to the use of the Services and/or the application, interpretation, or construction of these Terms of Use shall be resolved amicably.
In the event that an amicable settlement is not reached within sixty (60) days, the disagreement, issue, or dispute shall be referred to arbitration in accordance with the provisions of the Arbitration Act (Cap. 387 of the Laws of Malta). The sixty-day period will commence upon the formal written notification by either the Company or the User to the other party of the existence of a disagreement, issue, or dispute.
Indemnity And Release
Users are obligated to indemnify the Company, along with its parents, subsidiaries, affiliated companies, officers, and employees, and hold them harmless from all claims and expenses, including legal fees, arising from their use of the Services.
Additionally, Users shall release the Company, as well as its parents, subsidiaries, affiliated companies, officers, and employees, from any and all claims, demands, debts, obligations, damages (whether actual or consequential), costs, and expenses of any kind or nature whatsoever.
Modification Of Service
The Company reserves the right, at any time and periodically, to modify or discontinue, either temporarily or permanently, the services provided by the Company, in whole or in part, with or without notice.
The Company shall not be held liable to any User for any modifications, suspension, or discontinuance of the Services.
Violation Of Terms Of Use
Violations of these Terms of Use or any other rights of the Company empower the Company to pursue all available legal and equitable remedies against the responsible User, including, but not limited to, the termination of the Services.
The Company’s failure to enforce any right or provision in these Terms of Use does not constitute a waiver of such right or provision, nor does it waive any other rights or provisions contained in these Terms of Use.
In the event that a court determines that one or more rights or provisions in these Terms of Use are invalid, the remainder of the Terms of Use shall remain enforceable. To the extent permitted by law, the court shall give effect to the parties’ intentions, as reflected in any such right or provision that has been declared invalid or unenforceable.
